Personal Injury Damages and Comparative Fault

Serious car accidents are tragic and horrific events, causing not only painful injuries but often long-term or permanent additional expenses and challenges at work, home and in daily living. Having to bear these burdens and expenses only adds to the unfair and unjust nature of your experiences.

If you are injured due to the negligence or wrongful conduct of another, such as in an automobile accident, the law allows you to hold the negligent driver responsible and recover for the damage caused to you. 

Recoverable damages include the property damage to your vehicle, present and future medical expense, including costs of rehabilitation; present and future lost wages due to time you missed from work or if your injuries limit your ability to work or earn in the future, and the pain and suffering the accident has caused you to endure.

However, obtaining the compensation to which you may be entitled is not automatic or guaranteed. As the plaintiff in a personal injury case, you are required to prove the nature and extent of your injuries and prove that the defendant’s negligence caused them. The defendant, usually represented by the insurance company’s lawyers, will try to convince the jury that your negligence caused the accident or injury. The jury may assign each driver a portion of the responsibility for the accident. If you are found to be 50% or more at fault, then you cannot recover, but as long as the other driver is found to be more responsible, you can still recover that portion of the defendant’s negligence that caused your injuries.
